1. Warranty Period

Aurum Ceramic/Classic warranties each Opalite® restoration it fabricates to be free from defects in material or craftsmanship for TEN (10) YEARS.

2. Scope Of Warranty

The terms of this warranty apply exclusively to Opalite® crown or bridge restorations which have to be removed and replaced solely as a result of the failure of the Opalite® crown or bridge within ten years after fitting but no earlier than 6 months after fitting.

This Warranty covers only normal wear and tear of the Opalite® crown or bridge as outlined in the Warranty Period Section here above. If the Opalite® crown or bridge fabricated by Aurum Ceramic/Classic have defects in materials or craftsmanship within the specified periods, then Aurum Ceramic/Classic will remake the at no additional charge. All replacement will be comparable to those used in the original procedure completed by Aurum Ceramic/Classic.

3. Eligibility and Claim Procedure

The Opalite® Warranty is contingent on the following conditions:

• Aurum Ceramic/ Classic supplied Opalite® sold to, and inserted by, a licensed, practicing dentist in a clinical setting. All indications/contraindications observed.
• Oral hygiene maintained by the patient and regular semi-annual recall interval maintained.
• The original restoration must be returned to us within the relevant warranty period for the warranty to be honored. No work can commence on any claim until the original restoration is returned.
• Original Restoration must be returned to Aurum Ceramic/Classic with a new pick-up impression of the Restoration and opposing model.
• Dentists making a claim under this Warranty must be current in all amounts owed to the Aurum Group (includes but is not limited to Aurum Ceramic Dental laboratories Ltd., Classic Dental Laboratories Ltd., any affiliates and / or subsidiaries of either entity) at the time when the claim is submitted.

4. Warranty Exclusions

This Warranty does not apply to bonding failures. Cases where failure occurs due to debonding and poor occlusion are not considered to be the result of our inferior materials or craftsmanship. These warranties do not cover cases where a reduction coping is requested by the dentist. This Warranty also does not apply:

• where the failure is the result of a physical or other external effect or undue stress (e.g., CMD – Craniomandibular dysfunction), or
• where the model has not been prepared in accordance with relevant Aurum Ceramic/Classic instructions, in particular in the case of a tangential preparation, and
• where the restoration is inserted or fixed merely as a temporary restoration and/or flaking or chipping occurs at the margin area during removal.

The remedies provided herein are the eligible treating dentist's sole and exclusive remedies, and are not transferable. Cost incurred for removal or reinsertion, and incidental or consequential damages (including inconvenience, lost wages or pain and suffering) are not covered by these warranties. We do not give cash refunds. No alterations or changes to the original prescription are allowed and only one repair or remake per restoration is covered by these warranties.

Warranty benefits do not extend to any third parties, including without limitation, patients or intermediate suppliers. Cash refunds; temporary replacements; costs incurred for removal or reinsertion; cost incurred by another laboratory; breakage due to trauma, accident, neglect, abuse, failure of supporting bone, tooth or tissue structure or improper oral hygiene, are not covered under this warranty. The laboratory does not guarantee the performance of independent carriers.

The warranty also does not apply to any part of a restoration that has been, altered, repaired, or misused in any way that, in the opinion of Aurum Ceramic /Classic, would affect the reliability or detracts from the performance of any part of the restoration.

This warranty is in lieu of all other warranties either expressed or implied and may not be modified by any agent, employee or representative of the laboratory. In order to prevent any ambiguity of the language and the terms and conditions set out here in this Warranty, all the terms and conditions set out here in shall be exhaustive and shall exclude any other rights, benefits, and remedies.

5. Modification or Withdrawal of Warranty

Aurum Ceramic/Classic reserves the right to modify or withdraw this Warranty at any time without notice. Modification or withdrawal of this Warranty Program will not affect warranty benefits for Restorations that are placed prior to the effective date of the modification or withdrawal.

6. Effective Date

This warranty applies to Opalite® crowns and bridges placed after January 1, 2010

7. General Limitations on the Warranty

EXCEPTING THE TERMS AND CONDITIONS SET OUT HERE IN THIS WARRANTY, AURUM CERAMIC / CLASSIC, NOR ANY OF ITS AGENTS, REPRESENTATIVES, SUBSIDIARIES, OR AFFILIATES, MAKE ANY REPRESENTATIONS, WARRANTIES, OR COVENANTS, OR OTHER UNDERTAKING, EITHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, AS RELATES TO THE AURUM CERAMIC / CLASSIC-SUPPLIED RESTORATIONS, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES AS TO DURABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, SUCCESSFUL INTEGRATION, OR FUNCTIONALITY. FURTHERMORE, AURUM CERAMIC / CLASSIC, ITS AGENTS, REPRESENTATIVES, AND AFFILIATES, INDEPENDENTLY AND COLLECTIVELY DISCLAIM ANY AND ALL LIABILITY REGARDING LOST EARNINGS, INCOMES OR PROFITS, FAILURE BY THE TREATING DENTISTS TO CONFORM TO GENERALLY ACCEPTED DENTAL PRACTICES, AS WELL AS ANY DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL, OR SPECIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, RESULTING OR ARISING FROM EITHER THE MANUFACTURE, CONSTITUTION, DESIGN, USE, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR FUNCTION OF THE RESTORATIONS.

AURUM CERAMIC / CLASSIC WILL HAVE NO OTHER OBLIGATION WHATSOEVER WITH REGARD TO THE GOODS EXCEPT AS STATED IN THIS AURUM CERAMIC/ CLASSIC RESTORATION WARRANTY. THE WARRANTY IS EXCLUSIVE AND AURUM CERAMIC / CLASSIC HEREBY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SELLER BE RESPONSIBLE FOR INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR LIQUATED DAMAGES.
