1. Warranty Period

All Space Maintainers' cases are guaranteed against defects in materials and craftsmanship for 90 days per routine use at no charge.

2. EXTENDED WARRANTY Program also available!

Now you can insure your patient’s newly fabricated appliance for ONE FULL CALENDAR YEAR from their invoice date.

For a small fee per appliance, you can protect all of your newly fabricated appliances against:

• Loss
• Damage beyond repair
• Breakage

All covered appliances are remade according to the original prescription AT NO ADDITIONAL CHARGE FOR MATERIALS OR LABOUR!

Coverage on each appliance begins automatically when you register the case under Space Maintainer’s Extended Warranty Program.

3. Scope Of Warranty

This Warranty covers only normal wear and tear of Space Maintainer Orthodontic appliance as outlined in the Warranty Period Section here above. If the Orthodontic Appliance fabricated by Space Maintainers has defects in materials or craftsmanship within the specified periods, then Space Maintainers will remake the at no additional charge. All replacement appliances and will be comparable to those used in the original prescription completed by Space Maintainers.

4. Eligibility and Claim Procedure

The Space Maintainer's Orthodontic Appliance Warranty is contingent on the following conditions:

• Space Maintainers supplied Orthodontic Appliances sold to, and inserted by, a licensed, practicing dentist in a clinical setting. All indications/contraindications observed.
• Oral hygiene maintained by the patient and regular semi-annual recall interval maintained.
• The original Orthodontic Appliance must be returned to us within the relevant warranty period for the warranty to be honored. No work can commence on any claim until the original Orthodontic Appliance is returned.
• Original Orthodontic Appliance must be returned to Space Maintainers with a new pick-up impression of the orthodontic appliance and opposing model.
• Dentists making a claim under this Warranty must be current in all amounts owed to the Aurum Group (includes but is not limited to Space Maintainers Laboratories Canada Ltd., any affiliates and / or subsidiaries of either entity) at the time when the claim is submitted.

5. Warranty Exclusions

The remedies provided herein are the patient's sole and exclusive remedy, and are not transferable. Cost incurred for incidental or consequential damages (including inconvenience, lost wages or pain and suffering) are not covered by these warranties. We do not give cash refunds. No alterations or changes to the original prescription are allowed All claims must be processed through the dentist who places the order for the original orthodontic appliance. If no Extended Warranty as per Section 2 here above is purchased, there is only the 90 day coverage against material and workmanship. There is no coverage against loss without the Extended Warranty coverage.

Warranty benefits do not extend to any third parties, including without limitation intermediate suppliers. Cash refunds; temporary replacements; costs incurred for removal or reinsertion; cost incurred by another laboratory; breakage due to trauma, accident, neglect, abuse, failure of supporting bone, tooth or tissue structure or improper oral hygiene, are not covered under this warranty. The laboratory does not guarantee the performance of independent carriers.

The warranty also does not apply to any part of an orthodontic appliance that has been, altered, repaired, or misused in any way that, in the opinion of Space Maintainers, would affect the reliability or detracts from the performance of any part of the orthodontic appliance.

This warranty is in lieu of all other warranties either expressed or implied and may not be modified by any agent, employee or representative of the laboratory. In order to prevent any ambiguity of the language and the terms and conditions set out here in this Warranty, all the terms and conditions set out here in shall be exhaustive and shall exclude any other rights, benefits, and remedies.

6. Modification or Withdrawal of Warranty

Space Maintainers reserves the right to modify or withdraw this Warranty at any time without notice. Modification or withdrawal of this Warranty Program will not affect warranty benefits for Orthodontic Appliances that are order prior to the effective date of the modification or withdrawal.

7. Effective Date

This warranty applies to Space Maintainers Orthodontic Appliances ordered after January 1, 1984.

8. General Limitations on the Warranty

EXCEPTING THE TERMS AND CONDITIONS SET OUT HERE IN THIS WARRANTY, SPACE MAINTAINERS, NOR ANY OF ITS AGENTS, REPRESENTATIVES, SUBSIDIARIES, OR AFFILIATES, MAKE ANY REPRESENTATIONS, WARRANTIES, OR COVENANTS, OR OTHER UNDERTAKING, EITHER EXPRESS OR IMPLIED, WRITTEN OR ORAL, AS RELATES TO THE SPACE MAINTAINER-SUPPLIED ORTHODONTIC APPLIANCES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES AS TO DURABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, SUCCESSFUL INTEGRATION, OR FUNCTIONALITY. FURTHERMORE, SPACE MAINTAINERS, ITS AGENTS, REPRESENTATIVES, AND AFFILIATES, INDEPENDENTLY AND COLLECTIVELY DISCLAIM ANY AND ALL LIABILITY REGARDING LOST EARNINGS, INCOMES OR PROFITS, FAILURE BY THE TREATING DENTISTS TO CONFORM TO GENERALLY ACCEPTED DENTAL PRACTICES, AS WELL AS ANY DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL, OR SPECIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, RESULTING OR ARISING FROM EITHER THE MANUFACTURE, CONSTITUTION, DESIGN, USE, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR FUNCTION OF THE RESTORATIONS.

SPACE MAINTAINERS WILL HAVE NO OTHER OBLIGATION WHATSOEVER WITH REGARD TO THE GOODS EXCEPT AS STATED IN THIS SPACE MAINTAINER ORTHODONTIC APPLIANCE WARRANTY. THE WARRANTY IS EXCLUSIVE AND SPACE MAINTAINERS HEREBY EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SELLER BE RESPONSIBLE FOR INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR LIQUATED DAMAGES.
